H&C Applications

Overview

A Humanitarian and Compassionate (H&C) application allows individuals who do not meet the standard requirements for immigration to request permanent residency based on exceptional personal hardship. These applications are assessed on a case-by-case basis by IRCC and are meant for people already in Canada facing serious risk or hardship if forced to leave.

We provide trusted legal support for those whose situations call for compassion, discretion, and deep legal understanding.

Who Can Apply Under H&C Grounds?

You may be eligible to apply if:

  • You are living in Canada without legal status (e.g., overstayed, refused refugee claim, or undocumented)

  • You cannot return to your home country due to risk, danger, or extreme hardship

  • You have established strong ties to Canada (e.g., family, community, work)

  • You have children or dependents who would suffer if you are removed

  • You face unique health, gender-based, or domestic violence-related risks

You can only apply from inside Canada, and cannot apply if you have an active refugee claim in progress.

What IRCC Considers

  • Hardship you’d face if returned to your home country

  • Best interests of any children involved

  • Level of integration into Canadian society (community ties, work, language, etc.)

  • Medical, psychological, or social factors

  • Any past attempts to regularize your status

Documents Required

We help prepare a complete and compelling package, including:

  • Personal statement and hardship narrative

     

  • Medical and psychological reports (if relevant)

     

  • Letters of support from community, employers, schools, or religious leaders

     

  • Proof of work history, volunteer involvement, or education in Canada

     

  • Evidence of hardship or risk in your home country (e.g., news articles, legal reports)

Processing Time

  • Typically 18 to 24 months

  • Delays are common due to the complexity of cases and document verification
