Overview

Canada is committed to protecting individuals who face persecution, danger, or serious human rights violations in their home countries. Through the Refugee Protection Program, eligible individuals can make a refugee claim and apply for asylum from within Canada.

Who Can Claim Refugee Status in Canada?

You may be eligible to make a refugee claim if:

  • You are already in Canada and cannot return to your home country due to:
    • A well-founded fear of persecution based on race, religion, nationality, political opinion, or membership in a particular social group
    • Risk of torture, cruel treatment, or threat to life or safety
  • You are not inadmissible due to serious criminality or prior failed claims
  • You are making your first claim or were previously removed unfairly or without full review

Refugee claims can only be made from within Canada or at a port of entry (airport, land border, or seaport).

The Refugee Claim Process

  1. Submit your claim at a port of entry or online through IRCC

  2. Receive a confirmation of referral to the Immigration and Refugee Board (IRB)

  3. Complete the Basis of Claim (BOC) Form within 15 days

  4. Prepare for your IRB hearing, where you’ll present your case
  5. If successful, you’ll be granted protected person status and can apply for permanent residency

Required Documents & Support

  • Witness statements or letters of support

  • Medical or psychological evaluations (if needed)
